Terms of Use and General Terms Notice

These terms govern the use of this website. Brokerage and advisory services are subject to separate individual agreements.

1. Scope
These terms apply to the use of the website of Junge Capital Partners OOD (hereinafter “JCP OOD”). By themselves they do not establish any contractual relationship for brokerage or advisory services.
2. Non-binding content
Presentations of properties, regions and services are non-binding and do not constitute a legally binding offer (an invitation to make an offer / invitatio ad offerendum). Third-party information is reproduced to the best of our knowledge; no warranty is given as to its accuracy.
3. Property brokerage and commission
A brokerage or advisory engagement arises solely from a separate, written individual agreement (brokerage contract), not from the mere use of this website. Using the website, contacting us, receiving a property description and viewings are free of charge and do not give rise to any commission. A commission is owed only on the basis of an expressly signed brokerage agreement setting out its amount or method of calculation, due date and method of payment; where VAT applies, statutory value-added tax (ДДС) is added. Purchase, rental or other property contracts are concluded directly between the respective parties and, where legally required, executed as a notarial deed before a Bulgarian notary. JCP OOD acts as broker or adviser.
4. Identity verification and anti-money-laundering
As a real-estate broker, JCP OOD is an obliged entity within the meaning of чл. 4, т. 18 of the Bulgarian Measures against Money Laundering Act (ЗМИП). Before establishing a business relationship or carrying out a specific property transaction, we are legally required to establish and verify the identity of the parties and, where applicable, of the beneficial owner (чл. 53 ЗМИП), to record the purpose of the business relationship and, where necessary, to take appropriate measures to verify the source of the funds used and to determine any politically-exposed-person status. This requires presentation of a valid official identity document. The documents obtained are retained for the statutory period of five years (чл. 67 ЗМИП) and then deleted. The legal basis for processing is Art. 6(1)(c) GDPR (legal obligation); details are set out in our Privacy Policy.
5. Liability and external links
JCP OOD is liable in accordance with the statutory provisions of Bulgarian law. No liability is accepted for the content of linked external sites; their operators are responsible.
6. Copyright and rights of use
All content on this website — in particular texts, images, graphics, maps and their design — is protected by copyright. Private, non-commercial use of the website is permitted. Any reproduction, distribution or other exploitation beyond the limits permitted by law requires the prior written consent of JCP OOD. Property listings may not be systematically extracted or re-used for commercial purposes.
7. Right of withdrawal for consumers
For brokerage contracts concluded off-premises or at a distance, consumers generally have a statutory right of withdrawal of fourteen days (чл. 50 ЗЗП). Details and a model withdrawal form are provided to the consumer separately before the brokerage contract is concluded. If the consumer expressly requests that performance begin before the withdrawal period expires, the right of withdrawal may lapse upon full performance of the contract under the statutory conditions (чл. 57 ЗЗП). The competent consumer-protection authority is the Commission for Consumer Protection (КЗП), Sofia.
8. Governing law and jurisdiction
The law of the Republic of Bulgaria applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the European Union, this choice of law does not deprive them of the protection afforded by the mandatory provisions of their country of residence (Art. 6(2) Rome I Regulation). The courts of Burgas, Bulgaria shall have exclusive jurisdiction for all disputes where the contracting party is a merchant or a legal person. Where the contracting party is a consumer, jurisdiction in Burgas applies only to the extent permitted by Regulation (EU) No 1215/2012 (Brussels Ia); otherwise the statutory places of jurisdiction remain unaffected.
9. Severability
Should individual provisions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the legally permissible rule that most closely reflects its economic purpose.
