What should I consider when buying an apartment in a gated complex (operator model)?

Many apartments on the southern coast are in gated holiday complexes with a pool, garden and reception. Two things set them apart from an apartment in an ordinary building. First, the maintenance fee (taksa poddrazhka): the operator sets it in a management contract that, under the Condominium Management Act (ZUES, Art. 2), is notarised and registered in the property file of each apartment — it binds every later buyer too, is very hard to terminate unilaterally and is due regardless of use. Second, the land: depending on the contract you acquire only the apartment, sometimes via a right to build (pravo na stroezh), while the land and shared facilities may belong to the operator — unlike German condominium law, a co-ownership share in the plot is not guaranteed. The risk: if the operator becomes insolvent or some owners stop paying, upkeep can suffer or costs for the others can rise. In return the fee secures the upkeep of the pool, garden and security.
