What warranty applies to a new build from the developer?

New builds carry statutory minimum warranty periods under Art. 160(3) to (5) of the Spatial Development Act (ZUT) and Art. 20(4) of Regulation No. 2 of 31 July 2003: among others ten years for newly erected load-bearing structures including the foundation soil, five years for waterproofing, thermal and sound insulation, and three years in an aggressive environment. Eight years apply only to structures restored after accidents (Art. 20(4) of Regulation No. 2). The periods run from the use permit (Akt 16) and may not be shortened by contract. When buying off-plan it is worth checking the developer's standing and references, so the warranty is actually worth something if needed.
