What warranty applies to a new build from the developer?

New builds carry statutory minimum warranty periods under Art. 160 of the Spatial Development Act (ZUT) and Regulation No. 2 of 2003: among others ten years for the load-bearing structure and foundations, eight years for conversions and refurbishments, and seven years for waterproofing, thermal and sound insulation. The periods run from the use permit (Akt 16) and may not be shortened by contract. When buying off-plan it is worth checking the developer's standing and references, so the warranty is actually worth something if needed.
